The Cann Awards Official Rules


1. Eligibility

The Cann Awards (the “Contest”) is open only to legal residents of Austria, Australia, Canada, China, France, Germany, Mexico, United Kingdom, and United States who are age of majority in their jurisdiction at the time of entry. Void where prohibited by law. Employees of PROMETHEAN, INC. or any of its respective affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production execution or distribution of the Contest and their immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children) and household members (people who share the same residence at least three (3) months out of the year) of each such employee are not eligible. The Contest is subject to applicable federal, state, provincial and local laws and regulations. Approbation of these Official Rules and participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor

PROMETHEAN, INC., 1165 Sanctuary Parkway, Suite 400, Alpharetta, Georgia 30009 (USA).

3. Contest Entry Period

The Contest begins on September 10, 2014 at 12:01AM local time and ends on November 15, 2014 at 11:59 PM local time (the “Contest Entry Period”)[1]. Sponsor is the official time keeper for this Contest.

4. How to Nominate a Teacher

To enter you must nominate a teacher who inspired you to become the person you are today (the “Teacher”). During the Contest Entry Period, you can enter at (the “Contest Website”). On the Contest Website you must complete and submit the entry form as instructed (by proving your name, address, email address and phone numbers as well as that of the Teacher you are nominating), upload either: (A) an audio or video submission that is no longer than five (5) minutes; or (B) an essay up to five hundred (500) words (the “Entry”). The Entry should explain how the Teacher inspired you to become the person you are today and can focus on how the Teacher:

  • Displayed excellent leadership qualities
  • Encouraged students to explore and create
  • Inspired critical thinking among students
  • Responded to the diverse learning needs of students with importance
  • Has given successful direction to students’ careers
  • Motivated students towards positive thinking and positive ways of living
  • Inspired students towards developing problem solving attitude

(collectively the “Criteria”)

Technical Requirements:
  • The Entry needs to be in one of the following languages: 1) English; 2) French; or 3) German.
  • Written submissions must not exceed five hundred (500) words and must be in plain text (.txt) or Microsoft Word (.doc or .docx) format.
  • Audio or video submissions must not exceed five (5) minutes.
  • Video must be in AVI or WMV format, minimum resolution 320×240.
  • Audio must be in MP3 or WAV format.
Additional Requirements:
  • You must have been a student of the Teacher’s in a K-12 school (also known as primary school, junior high school or secondary education). Teachers cannot be nominated by peers, parents of students, etc.
  • You must no longer be enrolled in the school where the Teacher was your teacher.
  • Teachers of all grade levels (K-12 / primary or secondary education) and all subject areas are eligible.
  • In order to nominate a teacher you must show the Teacher these Official Rules and have his or her written consent to be nominated for this Contest. You will be required to provide accurate and current contact details for the Teacher (or his or her next of kin if the Teacher is currently not living) at the time of entry. If you are not able to locate a teacher or his or her next of kin, you may not nominate the Teacher. If you provide contact details for a Teacher’s next of kin the requirements and obligations stated in these rules will apply to such listed next of kin.
  • A Teacher may only be nominated once. Groups wishing to nominate a Teacher must select one representative to serve as the official entrant.
  • You may only nominate one teacher.

Entries must be truthful and Sponsor reserves the right to verify information contained in the Entry. Entries must be the original work of the entrant; must not infringe any third-party’s rights; must be suitable for publication (i.e., may not be obscene or indecent); may not contain defamatory statements; may not invade privacy, publicity or other rights of any person, firm or entity; may not in any other way violate applicable laws and regulations; may not contain any reference to any third party trademarks, names (other than the name of the nominee’s employer) or third party logos; and may not contain any copyrighted works owned by third parties. All Entries will be reviewed for content eligibility and compliance with these Official Rules before being judged. Entries containing false information, prohibited material or inappropriate content, as determined by the Sponsor, in its sole discretion, may be disqualified. Sponsor makes the final determination as to what Entries are eligible to take part in this Contest.

5. Grant of Rights

Submission of an Entry, and express approval of these Official Rules, grants Sponsor and its agents the unconditional, irrevocable, sub-licensable, worldwide right to reproduce, publish, distribute, exhibit, disseminate via network, publicly display, publicly perform, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the entrant, whether or not such Entry is selected as a winning Entry. BY SUBMITTING THE ORIGINAL ENTRY, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE AND INTEREST NECESSARY TO GRANT THE SPONSOR AND ITS AGENTS THE WORLDWIDE, IRREVOCABLE, SUB-LICENSABLE AND UNRESTRICTED RIGHT AND LICENSE TO REPRODUCE, DISTRIBUTE, EXHIBIT, DISSEMINATE VIA NETWORK, PUBLICLY DISPLAY, PUBLICLY PERFORM, ADAPT, PUBLISH, — USE, EDIT, AND/OR MODIFY SUCH ENTRY IN ANY WAY AND POST THE ORIGINAL ENTRY ON THE INTERNET OR — USE THE ORIGINAL ENTRY IN ANY OTHER WAY AND AGREES TO INDEMNIFY AND HOLD SPONSOR AND ITS AGENTS HARMLESS FROM ANY CLAIMS TO THE CONTRARY AND HEREBY WAIVES ALL MORAL RIGHTS THAT MIGHT OTHERWISE HAVE BEEN EXERCISABLE BY ENTRANT IN RESPECT OF THEIR ENTRY.

6. Selection of Cann Award Winners

All valid Entries submitted during the Contest Entry Period will be judged by a panel of qualified judges between November 16, 2014 and December 1, 2014 to first select thirty (30) semi-finalists and then five (5) potential winners. The Entries will be judged on the following two criteria:

  • How the Teacher inspired you to become the person you are today using the Criteria stated above in Section 4 (50%)
  • The strength to which the Teacher displayed each of the respective Criteria (50%)

In the event of a tie, the tie breaker will be based on the highest score in the first judging criteria, continuing thereafter to each judging criteria in order, as needed to break the tie. All submitted Entries and entrants in this Contest shall be governed by these Official Rules and the decisions of the judges and Sponsor. Entrants agree that the Sponsor and judges have the sole right to decide all matters and disputes arising from this Contest and that all decisions of Sponsor and judges are final and binding.


All potential winners (the person that made an Entry as well as the Teacher that was nominated) are subject to a background check (including, without limitation, civil and criminal court records and police reports). Sponsor reserves the right in its sole discretion to disqualify any Entry if the results of such background check or interview reveals that the entrant and/or the Teacher that was nominated is either not eligible to participate in the Contest or if the Sponsor determines, in its sole discretion, that participation of entrant might reflect negatively on Sponsor or any of its related or affiliated companies, employees, or affiliates, or if the Entry contains false, deceptive or incomplete information. Within 48 hours of being contacted as a potential winner, all potential winners (including the person that made an Entry as well as the Teacher  that was nominated) will be required to timely provide evidence such as one (1) day which objectively verifies the facts stated in the Entry to the satisfaction of the Sponsor and provide any requested written authorization, consents or releases in connection with such background checks. Failure to do so will result in disqualification of an entry. Entries may also be disqualified for: (a) failing to provide the required information in a timely manner; (b) a violation of any of these Official Rules (including failure to satisfy any eligibility requirements); or (c) any other reason affecting the fairness or propriety of this contest as determined by the sponsor in its sole discretion.

8. Verification of Potential Winners

The potential prize winners and nominated Teachers must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential winners and nominated Teachers will be notified by email, telephone, or registered mail on or about December 8, 2014. The potential winners (entrants) and nominated Teachers will be required to sign and return to Sponsor, within five (5) days of the date notice is sent, an affidavit of eligibility, liability/publicity release (except where prohibited), and other required documentation in order to claim his/her prize if applicable. If a potential winner (entrant) and/or nominated Teacher cannot be contacted, fails to sign and return the affidavit or for UK entrants, certificate of eligibility and liability/publicity release within the required time period (if applicable), or if the prize or prize notification is returned as undeliverable, potential winner forfeits prize. In the event that a potential winner (entrant) of a contest prize or nominated Teacher is disqualified for any reason, Sponsor may award the applicable prize to an alternate entrant who had the next highest score.

9. Grand Prizes (Cann Awards)

Five (5) grand prizes will be awarded. Each grand prize winner will receive a Cann Award which consists of: a) a trip for winner (entrant), Teacher and one guest (selected by the Teacher) to Atlanta, GA to attend an award presentation event on a date which shall be determined by the Sponsor (the “Trip”); and b) Twenty Five Hundred US Dollars (US$2,500 / €1837 (approximate)) donated from Sponsor to winning Teacher’s choice of a charity (the “Donation”). Approximate retail value of each grand prize is US$2000. Dollar value will vary depending on where winner resides due to cost of airfare. (The Donation does not have monetary benefit to the winner and is not included in this total). Full details for the Trip and Donation are below.

The Trip

The Trip will be for the winner, Teacher and one guest (selected by the Teacher). The Trip will be a 3-day/2-night trip to Atlanta, Georgia (USA). Sponsor will provide the winner, Teacher and its Guest with economy flights from its hometown to Atlanta. Airline, schedule and seating assignments will be arranged by Sponsor. Travelers will be required to attend an award presentation event during the trip to Atlanta. If winner or Teacher is unable to travel within the time period required, the prize will be forfeited. Each person that goes on the Trip will also receive US$100.00 per day for food (may not be used for alcohol) and miscellaneous expenses. Trip subject to availability and blackout dates. If any traveler lives within 150 miles of Atlanta, GA ground transportation may be provided instead of air transportation. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation (express as stated above), personal charges at lodging, security fees, taxes or other expenses or incidentals are the responsibility solely of winner. Travel companion must be 18 years of age or older as of the date of departure and must travel on same itinerary and at the same time as the Teacher. Teacher and travel companion will share a hotel room (single room / double occupancy). All travelers are required to have all necessary travel documents (i.e., passport and Visa) and travel insurance.

The Donation

The Donation will be from the Sponsor to a non-profit organization selected by the respective Teacher. The non-profit organization must be in good standing. The non-profit organization must not support or advocate for a controversial topic or position, as determined by the Sponsor in its sole discretion. Each Donation will be paid in a single lump sum by the Sponsor.

Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the listed prize for one of equal or greater value for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

10. Entry Conditions and Release

By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and/or the Contest judges which are binding and final in all matters relating to this Contest; (b) release and hold harmless the Sponsor and its respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Contest, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsor from and against any and all claims, expenses, and liabilities (including reasonable attorneys fees) arising out of or relating to an entrant’s participation in the Contest and/or entrant’s acceptance, use or misuse of prize.

For French residents: French Participants may only enter this Contest if they have an unlimited access to the internet via ADSL or cable or fiber, or if they use, for free, the internet connection of a third party, for example, an hotel or a coffee etc.

11. Publicity

Except where prohibited, participation in the Contest and express approval of these Official Rules constitutes winners consent to Sponsor’s and its agents’ use, publishing, editing and adaptation of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media or materials (printed materials, posters, commercials, press, online materials as for instance all PROMETHEAN-related websites, community and social networks pages, press, TV, radio, POS, etc.),worldwide, without further payment or consideration. For French entrants, this right is limited to 10 years from the date when he/she would have been confirmed as a winner.

12. General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

13. Limitations of Liability

Participation to the Contest by internet implies the acknowledgement by the Entrants of internet and IT systems technical limits. As a consequence, to the extent permitted by applicable laws (unless he Released Parties, acted negligently or willful act) the Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software, resulting from force majeure circumstances beyond the Released Parties’ control; (c) unauthorized human intervention in any part of the entry process or the Contest; (d) technical or human error which may occur in the administration of the Contest or the processing of Entries, resulting from force majeure circumstances beyond the Released Parties’ control; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize. If for any reason an entrant’s Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, resulting from force majeure circumstances beyond the Released Parties’ control, entrant’s sole remedy is another Entry in the Contest. No more than the stated number of prizes will be awarded.

If any provision of the Official Rules shall be held to be illegal, invalid or unenforceable under the laws of any jurisdiction, it shall be deemed modified to the minimum extent necessary to make it legal, valid and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to, or deletion of, a provision of part-provision under this clause 13 shall not affect the validity and enforceability of the remainder of the Official Rules, and the legality, validity and enforceability of the whole of the Official Rules in any other jurisdiction shall not be affected.

14. Disputes

Except where prohibited, Entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, and exclusively by a court of competent jurisdiction in Atlanta, Georgia; (b) any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Contest but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Promethean in connection with the Contest, shall be governed by, and construed in accordance with the laws of the State of Georgia without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

For Residents of France only: Section 14 above is not applicable. This Contest is governed by the laws of France, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than France. Accordingly, all question and issues concerning the construction, validity, interpretation and enforceability of these Official Rules (and other documents or materials referenced herein) or the rights and obligations of the entrant or the Sponsor, in connection with the Contest shall be governed by such laws.

15. Entrant’s Personal Information

Information collected from entrants about entrants and their nominated Teachers is subject to the Sponsor’s Privacy Policy which is available at The Sponsor’s Privacy Policy contains information on how entrants’ information may be used, stored and disclosed, including any overseas disclosure, as well as how entrants can access, correct or update their information, or complain about a breach of their rights. The Sponsor collects personal information in order to conduct the Contest. Participation in the Contest will be deemed to be your explicit authorization to transfer personal data that you submit to participate in the Contest to the United States, all for purposes of administration of the Contest and associated processing, and such personal data will be stored on a server in this country which may not offer an adequate level of protection of personal data.

16. Contest Results
